Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Experivise platform and services ("Services"), operated by Experivise Inc. ("Experivise", "we", "us", or "our").

By using our platform, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old to use Experivise. By using our platform, you confirm that:

• You are legally eligible to enter into a binding agreement
• All information you provide is accurate and complete

2. Account Registration

To use certain features, you must create an account. You agree to:

• Provide truthful, complete information
• Keep your credentials confidential
• Accept responsibility for all activity under your account

Advisors may onboard their clients, who in turn may interact through forms, uploads, and messaging within the Experivise platform.

3. Use of Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not:

• Upload or share false, illegal, or misleading data
• Attempt to gain unauthorized access to our systems
• Interfere with the integrity or performance of the platform
• Use the service for any malicious, fraudulent, or harassing behavior

4. Data and Privacy

Your use of the Services is subject to our [Privacy Policy].
By using Experivise, you consent to the collection and use of your information as outlined there.

You are responsible for ensuring your use of client data complies with all applicable privacy laws.

5. Payments and Billing

If you subscribe to a paid plan:

• You agree to pay all fees in accordance with your selected subscription
• Billing is processed through Stripe
• All payments are final and non-refundable, unless required by law
• Non-payment may result in suspension or termination of access

Free trials may be offered and are subject to the same terms.

6. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted availability.
Planned maintenance and occasional outages may occur.
We are not liable for any loss due to temporary unavailability or disruptions.

7. Intellectual Property

All content, software, trademarks, and materials on Experivise are the property of Experivise Inc. or its licensors.

You are granted a limited, non-exclusive, non-transferable license to use the Services, but you may not:

• Copy, modify, or distribute the software
• Reverse-engineer or resell any part of the platform

8. Termination

We may suspend or terminate your access if:

• You violate these Terms
• We detect misuse or unauthorized access
• We discontinue the Services (with advance notice)

You may also request termination of your account by contacting us.

Note: Some data may be retained for regulatory purposes for up to 7 years as required by law.

9. Limitation of Liability

To the fullest extent permitted by law, Experivise Inc. shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of data, profits, or business opportunities
• Errors or omissions in the Services

Use the platform at your own risk.

10. Indemnification

You agree to indemnify and hold Experivise, its affiliates, and staff harmless from any claims, damages, or liabilities arising from your use of the Services or violation of these Terms.

11. Changes to These Terms

We may update these Terms at any time.
When we do, we’ll notify users by email or in-platform notice.
Your continued use of the Services constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Province of Saskatchewan and the laws of Canada, without regard to conflict of law principles.
